Constructive dismissal, английский
  1. An employer’s behavior (either one serious incident or a pattern of incidents) creates a negative work environment, leading to an employee’s resigning. such behavior is considered a breach of contract and gives the employee the right to seek compensation in court.

  2. Constructive dismissal occurs when the employer makes a unilateral and substantial change to the terms of employment that represents a repudiation of the existing employment contract. this can permit the employee to resign and seek compensation as though he/she had been dimsissled without notice. the word “constructive” in this instance means “interpretive” – the employee asks the court to interpret his or her resignation as a dismissal.

  3. Constructive dismissal can arise where an employee has not been fired, but has been treated in such a way that the employer’s actions allow them to assert that their employment contract has been voided. this would be the case if the employer makes a unilateral and fundamental change to a term or condition of employment, without providing reasonable notice of that change. an employee asserting constructive dismissal typically quits their job and then sues the employer for damages for wrongful dismissal. 

  4. ‘constructive dismissal’ describes the situation where an employee is forced to leave his or her job because of the employer`s conduct. ‘constructive’ means ‘interpreted as’, so constructive dismissal happens when an employee interprets his or her position at work to be so unpleasant that it amounts to dismissal. it could be, for example, that the employer has committed a serious breach of the employment contract or has allowed bullying or unreasonable behaviour to continue over a period of time. the employee therefore feels that he or she must leave the employment because the situation is intolerable. in the uk constructive dismissal is grounds for a legal claim against the employer. vocabulary (c)

  5. A situation where an employee is treated so badly in the workplace that they are left with no choice but to resign. as a result, they can claim that they have been ‘constructively dismissed’.

    The provision of housing that is so substandard that, for all intents and purposes, a landlord has evicted the tenant. for example, the landlord may refuse to provide light, heat, water or other essential services, destroy part of the premises or refuse to clean up an environmental health hazard, such as lead paint dust. because the premises are unlivable, the tenant has the right to move out and stop paying rent without incurring legal liability for breaking the lease. usually, the tenant must first bring the problem to the landlord’s attention and allow a reasonable amount of time for the landlord to make repairs.
